EVNIX Terms of Service

These Terms govern the EVNIX mobile application, website, and project-management services operated by EVNIX INC, a Delaware corporation (“EVNIX”). By creating an account or using EVNIX, you agree to these Terms and the Privacy Policy.
Eligibility and accounts
You must be at least 18 and authorized to act for the person or business you represent. Provide accurate information, protect credentials, and notify EVNIX of suspected unauthorized access. Managers create company workspaces; Vendors and Clients join by invitation. Do not share access with unauthorized people.
Role responsibilities
- Managers are responsible for project administration, permissions, approvals, contracts, schedules, communications, and payment decisions.
- Vendors are responsible for bids, work, staffing, safety, insurance, licensing, code compliance, daily records, invoices, and submitted information.
- Clients are responsible for authorized use, contract payment obligations, and respectful communication.
EVNIX is a collaboration and recordkeeping tool. EVNIX is not a party to construction contracts, does not employ or supervise project participants, and does not guarantee workmanship, insurance, licensing, or payment.
Project agreements and EVNIX AI
Vendor agreements, project assignments, construction contracts, change orders, and payment terms may apply in addition to these Terms. EVNIX AI provides location-specific building-code and regulation research assistance—not architectural, engineering, legal, safety, inspection, or code-official advice. AI output may be incomplete, outdated, or wrong. Confirm requirements with the current adopted code, local amendments, project documents, authority having jurisdiction, and licensed professionals.
User content
You retain ownership of submitted content and grant EVNIX a non-exclusive license to host, process, display, transmit, and back it up to operate and secure the service for authorized project participants. Do not submit unlawful, malicious, infringing, deceptive, or unauthorized content.
Payments
Third-party payment and payout terms also apply. EVNIX does not store raw card or bank-account numbers. Users remain responsible for contract terms, taxes, refunds, disputes, retainage, lien releases, reporting, and required records. An EVNIX status is not a substitute for payment-provider or bank confirmation.
EVNIX subscriptions
If you choose a paid EVNIX subscription, checkout shows the price, currency, trial end, and billing date before you confirm. The current US offer is a 30-day trial followed by monthly billing at $80 for a Manager account, $10 for a Vendor account, or $5 for a Client account, unless checkout shows a different offer. Subscriptions renew monthly until canceled. To request cancellation or resolve a billing error, contact evan@evnix.app from your account email before the next billing date. Deleting the app alone does not cancel a subscription. Applicable law and the payment provider’s terms govern refunds and disputes.
Acceptable use
Do not access projects without authorization, bypass security, upload malware, harass users, misrepresent identity or qualifications, disrupt EVNIX, or use it to violate law or another person’s rights.
Availability, suspension, and deletion
EVNIX may change or suspend features and does not promise uninterrupted operation. EVNIX may restrict access for security, unlawful use, or material breach. You may request deletion in the app or on the deletion page. Shared construction and financial records may be preserved or anonymized where required.
Disclaimers and liability
To the maximum extent allowed by law, EVNIX is provided “as is” and “as available.” EVNIX is not liable for indirect, consequential, special, exemplary, or punitive damages; lost profits or data; project delay; defects; code violations; payment disputes; or decisions based on AI output. Nothing excludes rights or liability that applicable law does not allow to be excluded.
General and contact
Mandatory consumer, privacy, employment, construction, and payment laws continue to apply. Disputes must be brought in a court with lawful jurisdiction unless the parties agree to another lawful process. Questions: evan@evnix.app. Operator: EVNIX INC, Delaware, United States.
